Refusing to stay the upcoming Shiromani Gurudwara Prabhandak Committee (SGPC) elections, the Punjab and Haryana High Court on Wednesday issued notices to Punjab on an application demanding stay over the upcoming elections.
However, the high court made it clear that the result of the elections will be subject to the final outcome of the petition.
The full bench comprising Justice M M Kumar, Justice Alok Singh and Justice Gurdev Singh issued notices to Punjab without staying the election process.
The petition has been filed by the national president of Sehajdhari Sikh Federation, Paramjeet Singh Ranu.
Ranu has submitted that already a petition has been filed challenging the notification of October 8, 2003, “vide which voting rights of the Sehajdhari Sikhs have been taken away in a totally illegal and arbitrary manner”.
Without waiting for the high court decision, a proposal has been submitted to Punjab for holding election to the SGPC General House.
As the case came up for resumed hearing, the Punjab Additional Advocate-General and counsel for Central government told the court that notification for elections has already been issued and the date has been fixed as September 18.
The results would be declared on September 22. As such, the election process has already been initiated.
The application, apparently politically motivated and moved with mala fide intention to stall the election process, deserves to be dismissed.
It was also submitted the final electoral roll has already been prepared after deciding the objections of various persons and the matter regarding word “Sehjdhari” has already been clinched by the high court.
