USA Worldwide Outrage At Professor Davinderpal Singh Bhullar Death Penalty

Stockton's historical Landmark 'Pacific Coast Khalsa Diwan Society' hosted a press conference on July 10, 2011 to campaign against death penalty to Professor Davinderpal Singh Bhullar. Sikh religious societies and human rights organizations participated in the meeting. Professor Bhullar's mother Mrs. Upkar Kaur was a special invitee. Custodial deaths at the hands of Indian police during tortures are very common. Professor Bhullar's father and uncle were never traced after they were picked up by the Indian police.

Through a unanimous resolution, the "International Coordination Committee to Free Professor Bhullar" was formed. Manjit Singh Uppal, President of Stockton Gurdwara, Bhajan Singh Bhinder of Sikh Information Center and Tejinderpal Singh Bhullar, brother of Prof. Bhullar were included as founding members. The purpose of the committee is to coordinate efforts at the international level to expose mockery of justice and denial of due process of law to victims belonging to minorities in India and failing to protect life of all human beings under Universal Declaration of Human Rights.

It is strange that India is not a signatory to the Resolution of Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment. The resolution was adopted in 1985 and India continues to defy international pressure to honor Article 55 of the Charter of the United Nation.

Bhullar was tried under a fabricated and controversial law TADA which was allegedly used against minorities in the name of controlling terrorism. None of the 133 witnesses could link him with any terrorist activities, the presiding Justice of the three-member Bench of the Indian Supreme Court ruled not only against the death penalty, but also acquitted Prof. Bhullar of any terrorist activities. But two other justices under reportedly political pressure upheld the sentence. Prof. Bhullar was coerced to put his thumb impression on a blank paper which was later typed to make his confessional statement.

Professor Davinderpal Singh Bhullar's death sentence has aroused worldwide attention. Canada's NDP leader Jack Layton has termed Bhullar's trial 'questionable' and his conviction 'doubtful.' The European Parliament expressed doubt at India's ability to remain on 47-nation UN Human Rights Council as India in May 2011 assured to 'uphold the highest standards.' The campaign to free Bhullar has support of World Coalition Against Death Penalty, American Civil Liberty Union, and Amnesty International.

A report entitled The Faces of Terror in India researched and written by Bhajan Singh Bhinder and Patrick J. Nevers of Sikh Information Center was distributed to the participating members. It narrates with evidence how government of India runs systematic and orchestrated false flag operations to malign members of minority communities. The involvement of a serving Colonel in providing RDX from the military {censored}nals to arrange bomb blasts in the name of Muslim terrorist groups was detailed in a separate chapter. The killing of 36 innocent Sikh villagers during visit of the then president of the United States Bill Clinton too had links with Hindu terrorist groups. These groups are quite often disguised in robes of Swamis, and decorated civil and military officers.

Husan Laroya of Ajit Jalandhar, Satnam Singh Khalsa of Sade Lok, Gurjatinder Randhawa of Punjab Mail, Kuldeep Dhaliwal of Indo-American Dialogue and Amrik Singh of Examiner.com participated in the press conference.

Representatives of different organizations addressed the issues related with the Sikh community. I think it is a plan in best interests to have his death sentence 'reduced' to life imprisonment or something. But the way his trial was 'staged', he should get a re-trial.

Is there anyone on forum who personally knew professor sahib?

Life Impriosnment is usually 14 years...and Bhullar has already served 12 "WAITING" for "DEATH"....and IF the sentence begins form day of arrest (as it can happen depending on the Judge) he may walk free on the day the death sentence is changed to LI. Thats what happens in normal circumstances ...normal countries...here I am not so sure whats normal ??

No Life imprisionment is for whole life.State or central government has power to commute the sentence after 14 years but a prisoner cannot demand it as legal right.

No Life imprisionment is for whole life.State or central government has power to commute the sentence after 14 years but a prisoner cannot demand it as legal right.

Kds1980 ji so you are saying Hindu or Congress evil in India is because of the West. Do people have no brains in India and everyone bad is a West transplant! I just don't understand!

No the problem is many Human rights organisations started protests against Death penalty ,so Judges are in Dillema what to do and they have started giving Life sentences without commutation just as Judges in USA do

The reason I blame the west here is because USA is country which has highest cases of people serving life sentences without the possibility of Parole ,even minors in USA get this punishment.I find this punishment extremely inhumane but I don't understand why people don't protest against this

Prof. Bhullar's case is a test for the Sikh community. We should probably draw inspiration and lessons from the Indian Muslim community. In the case of Prof. Afzal Guru, they setup dedicated websites, approached International human rights organisations and printed several low-priced books in favour of their viewpoint. We too should ignore minor differences among us and become a rock solid community in the wake of this time of need. Strengthen the Panth.
Always remember 'United we stand, Divided we fall.'

I read from various sources that Mr. Bhullar fled to Germany following the abduction and killing of his father by Sumedh Saini, SSP Punjab Police. It is also said that Mr. Bhullar was fabricated and he was forced to confess his role in the MS Bitta Bomb Blast case and that the prosecution just relied on the confessional statement and 133 witnesses put down the Police's theory. It is also mentioned that Justice MB Shah who was a member of the divisional bench that tried Mr. Bhullar labeled the confession as "teller made confession" and rejected it.

Justice MB Shah acquitted Mr.Bhullar while two other judges confirmed the death sentence.

Now, the polygraph (lie detector) has been extensively used in various cases such as Nithari serial killings, Tandoor Murder case, etc. Let Mr. Bhullar also be given this chance so that his innocence is made known. Let Sumedh Saini and MS Bitta also undergo the same test publicly. Let the hidden truth come out.

Do the authorities have the guts to do this? The basic principle in the Indian criminal law is that an innocent should not be punished even if a guilty is let off. Will this principle be upheld?

May the truth and justice prevail.

I'm also curious to know why 90% of the death sentence convicts are poorest of the poor. The other person destined to the gallows Mahendra Nath Das on the same day as Mr. Bhullar is a poor villager in Assam. The last person hanged in India Dhananjoy Chatterjee was a poor watchman of an apartment complex who was convicted just on the basis of circumstantial evidences. Where as the death sentence of Sushil Sharma, a congress man convicted in the Tandoor Murder case was commuted. Same is the case with Manu Sharma (murderer of Jessia Lal).

By the way, MS Bitta bombing incident took place in 1993. What about the 1984 (9 years before 1993) cases of arson, rape and murder committed by congress men? This is for the Indian PM and Home Minister to answer.
