Islam Women's Rights In Islam

Islam gave women rights and privileges at a time when only barbaric manners and values dominated.
Yet, some people argue that Islam has alienated women in some domains. In fact, this belief is a misconception. People who say so, may have read about it in a magazine or seen it on TV. A quick examination of the issues judged as unjust to women will certainly correct the misunderstanding.

Man as the head of the household:

Some people believe that a woman in Islam is regarded as inferior to man since the Quran says (what means):"Men have one degree above women." [Quran 2: 228]



In the Quran it also says (what means): "Men are the protectors and maintainers of women, because Allaah has given the one more than the other and because men support them from their means." [Quran 4:34]

This verse implies that it is a man's duty to support his wife, and not the reverse, but this, in no way, makes him superior to her.

In fact, the rights and responsibilities of a woman are equal to those of a man but they are not necessarily identical. Since men and women are not created identical, they have different physical and emotional qualities, jobs and privileges. This does not mean that women are inferior.

On the contrary, women are considered crucial members of society in Islam since they are assigned the job of bringing up future generations. People today tend to look down at housewives but, in fact, raising children is one of the most important and difficult tasks. The way a mother brings up her child determines the way he will behave in the future. This duty, which requires patience, love, understanding and wisdom was significantly assigned to women in Islam because her nature suits this job.

Allaah The Exalted, in His Wisdom, has assigned a role for each member of the family so that there would be no arguments concerning who should do what. If a sailboat has two leaders, each will want to follow a path, leading ultimately to chaos and even a crash. In the same manner, how many times have your parents fought over some decision because each had their own point of view and wanted to apply it? This is precisely why it is preferable to have one leader for each household. However, this does not give the leader the right to be a dictator, or to neglect the role of his companion. This does not make him superior to other members of his family. It just gives him a larger duty.

Inheritance:

Some people claim that Islam is unjust towards women because it entitles them to inherit half of what men get. In fact, those people only know one side of the truth.

First, the principle of women inheriting half the money is only applicable in 45 percent of the cases. In the other 55 percent, women inherit the same amount or sometimes even more. For example, a mother and a father each inherit the sixth of their son's property when they are not the only inheritors.

In addition, the laws of inheritance in Islam are proportional to the duties of spending. Indeed, a man in Islam has the responsibility of supporting his family, his brother's children (when his brother dies), his parents (when they retire and do not have an income), his children from his previous marriage (if he has them) and his household, including his wife and children. A woman, on the other hand, does not bear this responsibility. She has the freedom to use the money she collects from her dowry or work as she pleases.

You might object here, saying that women today are working and helping their husbands pay the expenses, which entitles them to share equality with men. In fact, you should know that women's economic assistance to their husbands, which has become the norm today, is only an answer to the females’ wishes. Islam does not oblige women to spend on their households. It is a free choice many women have themselves taken today to feel more liberated, so it does not entitle them to a bigger portion of the inheritance.

Polygyny:

Polygyny is one of the most questioned principles that Islam grants men and women. Indeed, many people wrongfully accuse Islam of injustice because it allows a man to have up to four wives. Nevertheless, like every instruction in the Quran, polygyny has a reason. You see, Islam is a practical religion that acknowledges the needs and temptations of human beings and provides laws that deal with them, thus preserving harmony and morality.

- Polygyny might be the solution for a couple if the wife is barren, the husband wants children of his own and the option of separation does not appeal to both parties.

- If a woman is chronically ill and is unable to perform her marital duties. Polygyny may also be the solution when the couple does not want divorce.

- Polygyny is the religion's answer to cases where some men have excessive sexual needs that cannot be fulfilled by one wife. This in no way means that men should abuse this right and use it whenever they fancy a woman. It is rather a chance Islam has provided to prevent men from committing adultery. Many people who condemn polygyny cheat on their wives, calling this phenomenon a 'swift affair.' Islam, at least, has offered the second woman the option of being called 'a wife' rather than 'a mistress', especially in some countries where women remarkably outnumber men.

- Polygyny may settle the problem of an increased number of unmarried women, especially during wars.

However, polygyny has some limits and conditions to be met. Indeed, the Quran instructs the man to be fair with his wives on all levels, including treatment, money, house, etc. The only level where the man may have an uneven stance is the level of the feelings that he cannot control:

The Quran says (what means): "You will never be able to do perfect justice between wives even if it is your ardent desire, so do not incline too much to one of them [by giving her more of your time and provision] so as to leave the other hanging [i.e. neither divorced nor married]. And if you do justice, and do all that is right and fear Allaah by keeping away from all that is wrong, then Allaah is Ever-Forgiving and All-Merciful." [Quran 4:129]

Finally, it is worth knowing that Islam gives a woman the right to refuse polygyny for her husband by setting it as a condition during the marriage procedures. If this condition is set, then the woman is granted divorce if her husband marries another while he is still married to her.

You might ask, why could not there be polyandry (a woman having more than one husband)? The answer is simple. Islam did not allow it because Allaah is All-Aware that it will create a problem of kinship. This means that the child may not know who is actually his father (it could be anyone of the four husbands). In addition to the psychological damage it may cause, this problem also complicates the issue of inheritance. Even birds and animals do not allow polyandry.



This is the status of women in Islam; where terrestrial systems of systems of Islam just heavenly, Terrestrial systems does not sponsor women's dignity, since disowned the father of his daughter, while the age of eighteen years or less; to go out wandering on her face

Islam has honored women, and make it honorable man unlike systems that prepared the source of sin, and take away their right to ownership and responsibility, and makes them live in humiliation and contempt, and prepared by the unclean creature?.

Islam has honored women on the reverse of making women a commodity trading her body in propaganda and advertising?.
Islam has honored women in contrast to systems that are transmitted to swear allegiance to a deal to marry a wife; to be a property of the husband? Some even held their synagogues; to consider the fact whether it is women and the spirit of human beings or not? !.

Thus we see that Muslim women in worldly terms happy with her family in the confines of her parents, and care for her husband, her children, whether dander in the event of her childhood, or youth, or Hermha, and if their poverty or richness, or her health or her illness.

If there is shortening of the right of women in some Muslim countries, or of some to associate Islam - he is a failure because of ignorance, and distance from the application of the laws of religion, and the burden in on the mistake and religion is unconnected with the consequences of those shortcomings.
The remedy for that error can only be by reference to the guidance of Islam and its teachings; for the treatment of error.

The Western civilization can hardly know anything of such meanings, but look at the women look purely material, you see that hijab and chastity backwardness and reactionary, and it must be a puppet of tampering with every fallen; That is the secret of happiness for them.



Is it the means of education, culture, wear tight clothes and transparent and short?!.
Then any dignity when placed belles images in advertising and promotions?!
Why not promote them, but the beautiful Belle, if exhausted past her beauty and her adornment and threw neglected like any other machine that has expired? !.

And share a few beauty of this civilization? And the share of elderly mother, and grandmother, the old man?.
The share at best be in shelters, and the role of the infirm and the elderly; where visited and ask them.
And may have a share of the pension, or the like, shall devour him until you die; the womb is not there, and no link does not close the Crown.

The women in Islam, the more advanced age of increased respect for, and the greatness of its right, and compete with her children and relatives to honor her - as stated above - it does what is it, and who have remained at their children, and grandchildren, and her family, and society.

It would take a very enlightened man not to abuse this situation, given Islam goes into much detail about the delights of heaven geared towards the unenlightened, this is akin to giving two small children unequal presents, and expecting them to feel loved as equals.

do you not think that predefined roles are sexist? does not the ability to raise children, or earn a living depend on the individual?

Are you saying therefore that the man is unable to interfere with the decisions of the woman regarding upbringing? or does the man have complete authority?

What happens if the man is firing blanks? and the wife wants children of her own, and the option of separation does not appeal to both parties?

What happens if a man is chronically ill and unable to perform his marital duties? Does the woman cease caring for her partner and start worrying about the lack of sex?

If I were a chronically ill woman, with say breast cancer, on top of my illness, I have to worry about whether my husband is getting his end away? and if he is not, accept that he may come home and inform me he has married another? So when I am alone and dying, I can think that my partner, my love at least is getting his end away, priorities eh!

The title of this thread is womans rights in Islam, like most of your posts, the content tends to argue against the title, I have excessive sexual needs, and my wife is ill, the worrying thing about your argument is that for those men, like me, who instead find pleasure in non sexual acts, walking the dog, holding hands, cooking together, laughing together, they could in fact say, well who am I to argue with God, why make the effort to move on from a small problem and overcome it, when there is an answer to the problem right here, find another woman and make her a wife, Brilliant!

Many people who condemn polygyny do not cheat on their wives, many people love their wives through thick and thin, through breast cancer, loss of limbs, old age, its called a marriage, forever, no matter what transpires, I am more convinced than before that women have little or no rights in Islam.

Marriage in Islam is very much a contractual process. A woman has rights to specify her own conditions in the marriage contract, such as "I will be your only wife", etc.

The Muslim women I've encountered have been fierce in their faith and very confident. They hold their men accountable to an incredibly high standard.

The whole thing falls down when you start talking about the rights of slave women. But that is complicated and requires a lot of reading to see the Muslim point of view.

I think nice, honest people will be nice, honest people regardless of their religion. A.holes will be A.holes regardless of their religion. As Gyani ji said, it all sounds good in theory. Except the part about men being allowed to beat their wives, I still have trouble processing that one. But nice people won't do it anyway so it doesn't matter.

prophet Mohammad said:

1 - Women are the twin halves of men.
2 - The world and all things in it are valuable; but the most valuable thing in the world is a virtuous woman.
3 - The best women are the virtuous; they are the most affectionate to infants, and the most careful of their husband's property.
4 - When a woman performeth the five times of prayer, and fasteth the month of Ramadan, and is chaste, and is not disobedient to her husband, then tell her to enter Paradise by whichever door she liketh.
5 - Verily a great number of women are assembled near my family, complaining of their hubands; and those men who ill-treat their wives do not behave well. He is not of my way who teacheth a woman to stray.
6 - Asma, daughter of Yazid, said, "Victuals were brought to Muhammad, and he put them before some of us women who were present, and said, 'Eat ye.' But notwithstanding we were hungry we said, 'We have no inclination.' Muhammad said, 'O woman! Do not mix hunger with lies.' "
7 - Whoever doeth good to girls, it will be a curtain to him from hell-fire.
8 - Whoever befriendeth two girls till they come of age, will be in the next world along with me, like my two fingers joining each other.
9 - Whoever befriendeth three daughters, or three sisters, and teacheth them manners, and is affectionate to them, till they come of age, may God apportion Paradise for him.
10 - Whoever hath a daughter, and doth not bury her alive or scold her, or prefer his male children to her, may God bring him into Paradise.
11 - Shall I not point out to you the best of virtues? It is your doing good to your daughter when she is returned to you having been divorced by her husband.
12 - God enjoins you to treat women well, for they are your mothers, daughters, aunts.
13 - Do not prevent your women from coming to the mosque.
14 - The believers who show the most perfect faith are those who have the best disposition and the best of you are those who are best to their wives

Also the holy Quran announced her rights:

[And women shall have rights similar to the rights against them, according to what is equitable;]
[On the contrary live with them on a footing of kindness and equity]
[But bestow on them (a suitable gift), the wealthy according to his means, and the poor according to his means; a gift of a reasonable amount is due from those who wish to do the right thing. ]
[Let the women live (in 'iddat,) in the same style as ye live, according to your means: annoy them not, so as to restrict them]
[From what is left by parents and those nearest related there is a share for men and a share for women, whether the property be small or large, a determinate share]
[And to women what they earn:]
[Permitted to you, on the night of the fasts, is the approach to your wives. They are your garments and ye are their garments]
[O ye who believe! ye are forbidden to inherit women against their will. Nor should ye treat them with harshness, that ye may take away part of the dower ye have given them,]
[A divorce is only permissible twice: after that, the parties should either hold together on equitable terms, or separate with kindness. It is not lawful for you, (men), to take back any of your gifts (from your wives),]

the woman in the western world is only commodity in the hands of men ...


Abu Hurairah (May Allah be pleased with him) reported: Messenger of Allah (PBUH) said, "The believers who show the most perfect Faith are those who have the best behaviour, and the best of you are those who are the best to their wives ". [At-Tirmidhi].

Iyas bin `Abdullah (May Allah be pleased with him) reported: Messenger of Allah (PBUH) said," Do not beat Allahs bondwomen. "When `Umar (May Allah be pleased with him) came to Messenger of Allah (PBUH) and complained saying:" The women have become very daring towards their husbands, "He (PBUH) gave permission to beat them. Then many women went to the family of the Messenger of Allah (wives) complaining of their husbands, and he (the Prophet (PBUH)) said, "Many women have gone round Muhammads family complaining of their husbands. Those who do so, that is, those who take to beating their wives, are not the best among you ". [Abu Dawud].


Commentary:
This Hadith tells us that those who take to beating their wives are not perfect people. The decency of manners warrants that one must refrain from beating, as is evident from the conduct of the Prophet (PBUH) who neither resorted to beating with his own hand any of his wives nor slaves nor any other. He would avenge those who transgressed the limits of Allah.

Scientifically prone to forget the women, and women find themselves practically forget certain things and can not remain hesitant to say for sure, but the one mentioned .. In addition to the difference of woman's brain about the man's brain .. The women more susceptible to blood loss causing anemia have often temporary, which has a direct impact on her memory .. And God showed us in his states the reason, saying: remember each other ...

I have met many women who put men to shame in memory and intelligence. Unfortunately I'm not one of them, my memory is usually pretty terrible! :grinningkaur:

But also vice versa, as in my own case, some men remember more than some women.

I don't agree with such sweeping generalisations such as "women are more forgetful". Until science can show me some more information about memory and how it is different between men and women (like it has with spatial awareness) I'll keep following my personal experiences.

Also the thing about women having less religion because they menstruate and give birth, I personally feel this is a very antiquated notion and points more to a fear of the unknown rather than any failing on the woman's part.

And the part about anemia - I'm a woman (I menstruate, hooray!!), I'm a vegetarian, I don't take iron supplements, and I'm NOT ANEMIC! My husband on the other hand IS ANEMIC. Does that mean my husband's testimony in court is only worth 50%?

This is all one of the reasons I am Sikh and not Muslim. Boley So Nihal, Sat Sri Akaal.

But , I can't and don't take any of these posts too seriously. At times they seem more entertaining !!!
Brother Luckysingh ji I would not treat it as trivial or simply entertaining. These are beliefs held by Billions of Muslims. Naben ji is not saying or manipulating or flippantly stating these. I believe he is accurately stating what he is taught in his belief system.

There in lie the issues of outlook in various belief systems in the world.

Do I agree with what he postulates? Absolutely not and I find some stuff repugnant in my way of thinking or in reference to Sikhism teachings.

When it comes to financial matters and women I would remember the lyrics from 'theres no telling where the money went' and would agree that women always shop in twos so there might be something in that convention.

naben ji, this is not a scientific fact at all and neither is every thing stated in Quran is. Its a religious book not a scientific publication, neither is any other holy scripture.

No , its wrong. Instead of relying on random posters on the internet , why don't you read the explanation of Islamic Law , which is one of the largest and most comprehensive legal code of human history , from the scholars themselves?

Here is what a Ph.d in Islamic Studies, Dr. Jamal Badawi, professor at Saint Mary's University in Halifax, Nova Scotia, Canada, and a cross-appointed faculty member in the Departments of Religious Studies and Management , says on the issue:

Most Qur'anic references to testimony (witness) do not make any reference to gender. Some references fully equate the testimony of males and females.

One reference in the Qur'an distinguishes between the witness of a male and a female. It is useful to quote this reference and explain it in its own context and in the context of other Qur'anic references to testimony:

(O ye who believe! When ye deal with each other, in transactions involving future obligations in a fixed period of time, reduce them to writing. Let a scribe write down faithfully as between the parties: let not the scribe refuse to write: as Allah Has taught him, so let him write. Let him who incurs the liability dictate, but let him fear His Lord Allah, and not diminish aught of what he owes. If they party liable is mentally deficient, or weak, or unable Himself to dictate, let his guardian dictate faithfully, and get two witnesses, out of your own men, and if there are not two men, then a man and two women, such as ye choose, for witnesses, so that if one of them errs, the other can remind her.) (Al-Baqarah 2:282)

A few comments on this text are essential in order to prevent common misinterpretations:

a. It cannot be used as an argument that there is a general rule in the Qur'an that the worth of a female's witness is only half the male's. This presumed "rule" is voided by the above reference (24:6-9), which explicitly equates the testimony of both genders on the issue at hand.

b. The context of this passage (verse, or ayah) relates to testimony on financial transactions, which are often complex and laden with business jargon. The passage does not make blanket generalization that would otherwise contradict 24:6-9, cited above.

c. The reason for variations in the number of male and female witnesses required is given in the same passage. No reference is made to the inferiority or superiority of one gender's witness or the other's. The only reason given is to corroborate the female's witness and prevent unintended errors in the perception of the business deal. The Arabic term used in this passage, tadhilla, literally means "loses the way," "gets confused," or "errs." But are females the only gender that may err and need corroboration of their testimony? Definitely not, and that is why the general rule of testimony in Islamic law is to have two witnesses, even when they are both male.

One possible interpretation of the requirements related to this particular type of testimony is that in numerous societies, past and present, women generally may not be heavily involved with and experienced in business transactions. As such, they may not be completely cognizant of what is involved. Therefore, corroboration of a woman's testimony by another woman who may be present ascertains accuracy and, hence, justice. It would be unreasonable to interpret this requirement as a reflection on the worth of women's testimony, as it is the only exception discerned from the text of the Qur'an. This may be one reason why a great scholar like At-Tabari could not find any evidence from any primary text (Qur'an or hadith) to exclude women from something more important than testimony: being herself a judge who hears and evaluates the testimony of others.

d. It must be added that unlike pure acts of worship, which must be observed exactly as taught by the Prophet, peace and blessings be upon him, testimony is a means to an end, ascertaining justice as a major objective of Islamic law. Therefore, it is the duty of a fair judge to be guided by this objective when assessing the worth and credibility of a given testimony, regardless of the gender of the witness. A witness of a female graduate of a business school is certainly far more worthy than the witness of an illiterate person with no business education or experience.

Regarding the topic of women in Islam , it is clearly evident that Islam is one of the most 'feminist' religion out there. Islam started in 7th century in the tribal society of Arabia. In those times , Arabs used to bury their daughters alive. Women had no legal , economic , property rights. Situation of rights was not any better in the Christian Europe too. After the advent of Islam, Arabs got revolutionized. Islam explicitly gave women these rights in 7th century...

1-Right to secular education.
2-Right to divorce (even on the basis of sexual dissatisfaction from a man)
3-Right to independent property .
4 Right to
inheritance of the family property.
5-Right to do independent business.

Now , when did women of other cultures got those rights? Probably centuries after Muslim women? Which other religion *explicitly* gives all these rights to women? Remember , explicitly means that we don't have to 'interpret,re-interpret' etc. It is written in Islam right there! Today people ,specially in the West, blame Islam for many bad practices of the Muslim societies such as honor killings or women rights in Saudi Arabia etc but all this has nothing to do with Islam. Cultural practices should not be mixed with the religion. 100,000 women have been raped in Congo , is it a fault of Christianity? Even today , little young girls are BURNED ALIVE in Christian parts of Africa due to witch hunt...but Christians will call this 'ignorance' of Africans instead of blaming it on religion...but why then show double standards when it comes to Islam? Honor killings in India is not due to Sikhism or Hinduism , is it? Female infanticide is also not due to Sikhism or Hinduism. So why blame all social problems in Muslim societies on Islam?

Here's something interesting though ... If you read the Medieval European criticism of Islam , one of the main criticism was that Islam gives too much liberty to the women(and slaves).

Islam is the most pro-women religion out there. Having read both the books , Bible and Qur'an , I can easily claim that Qur'an gives women way , way more rights than bible ever does (specially the OT of the bible is particularly repressive to women).... If Islam was actually anti-women , why would women themselves have defended Islam everywhere? Why would hundred of thousands 'Western' girls (mostly
University graduates) have accepted Islam , after a detailed study of the faith? (The average age of female convert to Islam in U.K is 27. Conversion occurs after a detailed period of study of the faith ..usually 3 to 4 years ... From 'Independent's report on Islam in U.K' ) ..
