Punjab policemen beat up woman after she complains of sexual harassment

Jalandhar: Several personnel of the Punjab Police were caught on camera beating up a woman in Taran Taran on Sunday. The woman had reportedly complained of sexual harassment. She said that she had been harassed by truck drivers.

However, the policemen started beating up the woman's father after he approached them. When the woman intervened, she was pushed, thrashed, slapped on the head, hit with a lathi and shoved aside. The police also reportedly sided with the truck drivers.

Four of the policemen were later suspended and a departmental inquiry has been ordered.

Speaking to reporters, the woman said, "My father and brother went to talk to the truck drivers who were harassing me. The policemen standing there asked what was happening. Once they learned what happened they took the drivers' side and started beating us."

Congress leader Sunil Jakhad said that this was not an "uncommon instance". "This is police brutality. There is no law and order in Punjab. Now (CM Parkash Singh) Badal has ordered an inquiry. Suspension and inquiry are not the cure for such things. It is just a reflection of how the Akali-BJP government is functioning. This is goonda raj in uniform."

Former IPS officer Kiran Bedi vented her anger against the errant policemen and said that suo motu action could be taken against them. "The video is evidence. They have got proof. They can take suo motu action," she said.

The incident speaks volumes about the attitude of the policemen towards women in the country.

Blame and blame some more. All this talk is just so much whooey. Punjab police have always been a bunch of thugs whoever is running the government. I shall not suggest they all be taken out and shot, but perhaps a period of "rigorous imprisonment" might help. Or it might not.

The real villain is the Punjabi culture which is patriarchal, misogynistic and glorifies violence. Only a paradigm shift will solve this problem.

No problem. I amend that final statement:

Mai Ji,
surely you havent been to the countryside elsewhere in India. The problem is much complex and deep rooted, beyond Punjab or Punjabi culture. What I believe is that the whole modern Southeast Asian shares this defect.
We the people, who glorify our country as a female figure, are yet to learn how to respect our females. To blame the Punjabi culture is a li'l too selective IMHO.

surely you havent been to the countryside elsewhere in India. The problem is much complex and deep rooted, beyond Punjab or Punjabi culture. What I believe is that the whole modern Southeast Asian shares this defect.
We the people, who glorify our country as a female figure, are yet to learn how to respect our females. To blame the Punjabi culture is a li'l too selective IMHO.

That is true and I am well aware that India is a h***hole for women. I am talking only about Punjab because this thread in about Punjab police.

CM orders magisterial probe into Tarn Taran incident

CHANDIGARH:
Taking serious cognizance of the alleged thrashing of a woman by the Policemen in Tarn Taran district, the Punjab Chief Minister Parkash Singh Badal today ordered a magisterial probe into the incident.

Disclosing this here today a spokesperson of the Chief Minister’s Office said that, the Chief Minister has directed the district magistrate Tarn Taran to ascertain the causes and circumstances which led to this incident and submit the inquiry report within three weeks.

Reiterating the commitment of the state government to protect the dignity and honour of the women, Badal categorically said that this was an unpardonable offence and any one connected with this grave crime, howsoever influential he may be, would not be spared and brought to book as per the law of the land.

Taking note of media reports of the thrashing by police of a Dalit woman and her father in Punjab and a group of teachers in the Bihar capital Patna, the Supreme Court Monday issued notice to the chief secretaries of both the states.

An apex court bench of Justice G.S. Singhvi and Justice Ranjana Prakash Desai while issuing the notice said: "We are taking suo motu congnisance...after seeing the disturbing visuals on television."

Some Punjab Police personnel were caught on camera brutally thrashing a young Dalit woman and her ex-serviceman father in public after she approached them to file a sexual harassment case in Punjab's Taran Taran district Monday.

In another case, nearly 50 fixed-pay teachers on contract, including women, were injured in police lathicharge during a protest in Patna Tuesday. The teachers were demanding permanent jobs and equal pay for equal work.

The court has directed Attorney General G.E. Vahanvati, Additional Solicitor General Haren Rawal, senior counsel Harish Salve and U.U. Lalit to assist the court in the matter.

The court has listed the matter for March 11.

NEW DELHI/CHANDIGARH: The Supreme Court today rejected Punjab government’s explanation regarding investigation of police officials who were caught on camera while beating a young woman in Tarn Taran in full public view on March 7.

The angry judges questioned, “Was she a terrorist?”

The state government explained that a magistrate will be appointed to determine the accountability for the thrashing of the victim on the roadside.The judges were not happy with the state’s explanation and questioned the need of an inquiry when the assault video has been seen by millions of people.

“Our experience shows the policemen will be reinstated after three months,” the judges said.

Punjab police DGP Sumedh Saini has been ordered to submit details of how the errant cops have been penalized.

The police assault victim has alleged that she was beaten by the cops after she complained of sexual harassment by a truck driver while returning home after attending a marriage.

On the other hand, police while acknowledging the fact that the assault on her was not justified said she had tried to prevent the cops from arresting her father, who was allegedly drunk in public.

The Apex Court has also taken a notice that nobody tried to help the victim while she was being mercilessly beaten."What is the accountability of citizens? People were standing around ..what were they doing? Are we becoming a senseless society? This happens every day in all parts of the country," the judges said.

Earlier, the Supreme Court had sought explanation from Punjab and Bihar government for police brutality on women. Women teachers protesting for hike in pay were hit by constables with batons and tear gas in Patna.

What exactly are citizens supposed to do? Argue with the police. The citizen who filmed the encounter did the best that could be done.

Citizens standing around dare not do more than stand around. To do more could be and probably would be considered interfering with a police action. In the US this would get you arrested, jailed and held on bail for a hearing. Under the circumstances in Punjab it would probably get you even more than that. Judges are a part of the problem when they respond with shock... this is not the first such story and the inertia in all parts the judicial system, including the courts, according to all reports, has been historic.

It is sad and tragic to admit that how family status and connections are important in the police cases especially in the places like India, Brasil, Mexico and others. When I was about 13, I used to take out the tail pipe so my Vespa could be louder than ever and ride in front of the police station for them to stop me so I could say what my last name was. They all knew who we were in Ferozepore. We all rode on our Vespas and Lambrettas to our schools.

It was part childish, ignorance laced with arrogance.

Mincing no words to say that the Punjab Police acted in a “barbaric manner” before making miserable the life of a young woman assaulted by the Tarn Taran police, the Punjab and Haryana High Court today gave the Amritsar range Inspector General of Police a 24-hour ultimatum to transfer seven erring policemen out of the district. Protection has also been ordered for the victim and her family. Eventually, it is to be provided by a central force, and not the state police.

Rapping the police for interference in the cause of justice, Justice Ranjit Singh also directed the IGP to ensure that the Tarn Taran Senior Superintendent of Police or any other police officer did not approach her, or was even seen near her. The IGP was told to act, or be present before the court on Tuesday.

The directions came after Justice Ranjit Singh was told that the Tarn Taran SSP offered Rs 5 lakh to the victim for brushing the matter under the carpet. Before issuing the directions, Justice Ranjit Singh interacted with the victim and her father to assure himself the veracity of their allegations.

The officials “responsible for assaulting the lady” and now to be transferred out are Ashwani Kumar, Paramjit Singh, Narinder Singh, Harjinder Singh, T{censored}m Singh, Gurdeep Raj and Davinder Kumar. “If the order is not complied by tomorrow, the IGP, Amritsar range, shall remain present here to explain reasons,” Justice Ranjit Singh added.

The matter was placed before Justice Ranjit Singh after the victim, her father and other relatives moved the High Court. They were seeking necessary action against police “not only for blatant violation of their basic human rights” and outraging the victim’s modesty in full public view, “but also for threats being advanced to them for withdrawing the complaint”.

Directions were also sought for an inquiry by an independent agency other than the state police and for transferring or placing under suspension the services of erring cops for “dereliction of duty to uphold the rule of law”. Keeping in view the urgency involved in the matter, the case was fixed for hearing less than an hour after it was filed this morning. At the time of hearing, the victim, her father and other relatives were present in the Court.

Taking cognizance of allegations of threat by the police to withdraw the complaint, Justice Ranjit Singh observed: “Prima facie, this may be so as the Supreme Court has taken a serious notice of this incident, when it appeared in the news and TV channels. Once the Apex Court has taken this action, the reaction of the police obviously would be to pressure the petitioners to succumb and compromise, which the police then would wish to place before the Supreme Court to get out of the tight situation”.

Justice Ranjit Singh also took note of the assertion that some recordings by the petitioners would indicate the amount of pressure being exerted on them to withdraw the complaint.

“The police cannot be permitted to act in a highhanded way. Once the Supreme Court has taken notice of the incident, the action by the police is interference in the cause of justice. First the police acted in this barbaric manner. Now, they have made the life of the petitioners miserable….,” Justice Ranjit Singh observed before parting with the case. It will now come up for further hearing on Tuesday.

All that contributes to this action is they can get away with it. The issue goes much deeper than man vs woman as they take sings and boil them alive too.

You know what the issue is, you also know the solution.

Edit- Punjabi culture is Dulla Bhatti and Guru Nanak Dev Ji, remember that this country inherited its institutions from the British. It was a colony, where over 1.5billion deaths were caused, how do you expect slaves to act?

SC rejects Punjab probe report in woman assault case

NEW DELHI: The Supreme Court has rejected the Punjab govt's magisterial probe report on assault of a woman by police at Taran Taran.

The apex court castigated the magistrate for saying police need to resort to lathicharge in such situations indicating that the girl and her father were the aggressors.

The court also said it will look into the role of senior police officers in the state and the manner in which they handled the Taran Taran incident.

SC said it will impose heavy cost on Punjab and Bihar governments for police assault on unarmed women.

The Supreme Court today rejected the Tarn Taran District Magistrate’s (DM) probe report giving a clean chit to the policemen involved in thrashing a 22-year-old girl on March 3 and directed the Chandigarh Administration to provide security to her and her family members.

The DM’s report “is thoroughly misleading”, besides containing factual errors, a Bench of Justices GS Singhvi and Kurian Joseph said in its order passed after hearing pleas for a CBI inquiry into the incident.

During arguments that lasted over an hour, the Bench held out the threats of suspending the DM, imposing “heavy penalty” on the Punjab Government and summoning the state police chief, but did not make these part of its order, which merely indicted the state for its role in the entire issue.

“We are of the opinion that the Punjab Government has not taken corrective measures and no effort has been made to address the grievance of the victims of police atrocities,” the Bench said in the order.

The state government said Central Industrial Security Force (CISF) personnel were already providing personal security to the victims. However, the Bench made it clear that there was no point in asking the state police or any personnel under the state government to protect the victims.

Assisting the Bench as amicus curiae, senior counsel Harish Salve strongly pleaded for a CBI inquiry as the police had taken action against the victims, instead of the erring police officials or the taxi drivers who had sexually harassed the girl.

“It is shocking that a magistrate had the audacity to tell the apex court that the police had to lathicharge the girl and her father to maintain law and order. To add insult to injury, the police extracted an apology letter from the father,” Salve said.

Instead of unleashing brutality on the victims, the police should have arrested the constables on the non-bailable charge of committing a crime under the SC/ST Prevention of Atrocities Act, he said.

The Bench said the state government had apparently ordered the magisterial inquiry after the SC had taken suo motu notice of the incident. Appearing for Punjab, Additional Solicitor General Sidharth Luthra said this was not correct. At this, the Bench said the officers would have fabricated the records for the purpose.

Attorney General GE Vahanvati also expressed shock over the fact that the victim’s father had been made to apologise for the incident which invited a sarcastic comment from the Bench: “The father is lucky to be still alive.”

ASG Luthra said the lathicharge was the result of an altercation with some policemen in which their turbans were removed. Unconvinced, the Bench wanted to know whether any FIR had been registered to this effect. It also asked if the girl or her father was wielding any weapons. Further, it wanted to know the nature of injuries suffered by the taxi drivers, who according to the government, had been attacked by the family members of the girl’s family. Luthra said the taxi drivers were absconding. The Bench said it showed the “efficiency” of the state police.

The Bench also questioned the logic of the Punjab Police chief going on television just a day after the girl was thrashed to defend the police action. Salve said this was the first time in decades of his legal practice that he had across such an atrocious incident.

During the arguments, the Bench also made it clear that the police and the government had to produce video records to defend themselves. “Tell us the TV channels have produced fake videos. Only that can go in your favour. Are you denying the incident? What was the crime the lady had committed for which she had to be thrashed on the highway in full public view?”

The SC also made it clear that this incident was symbolic of what was happening in most parts of the country on a regular basis. Police had thrashed the girl and her father when they wanted to lodge a complaint against the taxi drivers for eve-teasing her and making vulgar comments.

The Bench posted the next hearing in the case, instituted by the court itself after taking suo motu notice of the incident, for April 11, indicating that it would pass an order keeping the larger need to prevent such happenings in future.

It's just too hard to resist on wanting to go to India and gives these Thugs, whoops i mean "Officers" a good beating or two, reading the article was bad but watching the video was unbearable.

Things like these events that happen just help prove my point that government and those who work to enforce the government law should never be trusted.

People in this world have either become scared to fight back, or then people would only offer help when they feel a reward will be given to them. No one nowadays help people for the sake of helping no more, corruption of how the government works has effected the people, capitalism doesn't only work in economic but it works within our own mentality.
