No reprieve from HC, Sajjan trial to go on

A week after the Supreme Court stayed for two weeks the trial against Congress leader Sajjan Kumar in an anti-Sikh riot case, the Delhi High Court on Friday declined to grant the same relief to him in another case charging him with murder and rioting.

While Justice A K Pathak admitted the revision petition of the former Member of Parliament against framing of the penal charges by a lower court in July, he refrained from staying the trial till the final adjudication of the plea.

The case relates to the killing of six persons in Sultanpuri area during the riots that broke out in November 1984 and Kumar has been charged with inciting the mob and participating in the conspiracy to murder. The court has also issued notice to the Central Bureau of Investigation on his petition and asked the probe agency to file its reply by September 16.

The politician has two CBI cases registered against him, one of which, a case involving the death of five persons in the Delhi Cantonment area, was stayed by the apex court last Friday.

Kumar had challenged his prosecution and also the observations of the High Court that had dismissed his petition on July 19. The High Court had made some harsh observations regarding the evidence suggesting his complicity in the offences and also the motive of the investigating agencies. The judge had also ordered for expeditious hearing in the cases, for the country was looking for a verdict in the cases.
