The Delhi High Court today acquitted three people accused in a 1984 anti-Sikh riots case for lack of evidence.

A bench comprising Justices A K Sikri and Ajit Bharioke acquitted the three, Brij Mohan Verma, Mangal Sein and Bhagat Sen, who are lodged in the Tihar jail and ordered their immediate release .

The court held that prosecution had failed to prove the involvement of the three accused in an incident in Shastri Nagar area where Joginder Singh and his two sons were attacked on November 1, 1984 when the riots broke after the assassination of then Prime Minister Indira Gandhi.

On August 29, 20O9 the trial court had held the three guilty of attempt to murder and sentenced them to life imprisonment.

Though the names of the three never appeared in any of the charge sheets filed by the police earlier, the case was re-opened after the complainant filed an affidavit before the Ranganath Misra commission of inquiry seeking damages.

Puneet Ahluwalia, lawyer for Verma, contended that the names of the three never figured as accused but later they were framed to get the compensation.

The three were accused of setting the house of Joginder Singh on fire and charged under Section 307 of Indian Penal Code (attempt to murder) but the court found no evidence to prove their involvement, Ahluwalia said.
