More trouble is brewing for Union urban development minister Kamal Nath as the victims of 1984 anti-Sikh riots have urged United States government to deny his request for “diplomatic immunity”.

Gurpatwant Singh Pannun, legal advisor, Sikhs for Justice (SFJ) told DNA that besides the civil case he has been facing in New York court they are also filing a criminal case against him under “Human Rights Enforcement Act of 2009” in the US within a week.

They have also demanded expulsion of Kamal Nath from the cabinet for his alleged role in the riots.

In order to seek early justice, protesters in Delhi urged prime minister Manmohan Singh to expel Kamal Nath from the cabinet and not seek diplomatic immunity for him. They threatened to go on hunger strike if their demands were not met.

DNA was first to report that Kamal Nath is the first Indian who has been facing charges under Alien Tort Claims Act (ATCA) & Torture Victim Protection Act (TVPA) in a US court. Under this law, if found guilty, he will have to give compensation to the victims. If he fails to respond to the US court summons, his property and assets in US will be seized.

“Once the trial starts, Kamal Nath, earlier represented by his lawyer, will have to appear in the US court to present his testimony,” legal advisor to SFJ told DNA.
