Court summons SAD secy in party constitution case
I P Singh, TNN | Aug 27, 2011, 06.15AM IST JALANDHAR/HOSHIARPUR: A Hoshiarpur court has summoned Shiromani Akali Dal secretary Daljit Singh Cheema to produce the party constitutions - one submitted to the Gurdwara Election Commission and other to Election Commission of India - before it on October 28.
The summons were issued by the court of chief judicial magistrate, R K Singla. Cheema has been asked to appear as a witness and bring the copies of constitution submitted by the party with Gurdwara Election Commission (before the SGPC elections of 2004) and the election commission.
The criminal case was filed here by Malta Boat Tragedy Probe Mission Chairman Balwant Singh Khera in February 2009, against SAD president and deputy chief minister Sukhbir Badal, party secretary general Sukhdev Singh Dhindsa, Cheema and party`s Hoshiarpur district president Surinder Singh.
The petitioner had alleged that the party had filed two separate constitutions, contents of which were contrary to each other. The constitutions were also attached with the complaint as annexure. The complainant had pointed out that the two constitutions have different types of criteria for membership. According to the one submitted to the election commission, any adult can become a party member, but the other filed before the gurdwara poll commission allows only Sikhs to be its members. The complainant alleged that SAD, headed by Parkash Singh Badal, had submitted a false constitution for the sake of seeking registration/recognition from the Election Commission of India. The party also submitted an attested copy of the constitution before the gurdwara poll panel, which conformed to the conditions of the Sikh Gurdwara Act.
While arguing that the leaders had committed a serious crime and were liable for prosecution as provided by law, the complaint alleged that a case under sections 465, 466, 467, 468 and 471 of IPC was made out against them.
