You may notice that the family of the victim is bringing a "wrongful death" case; this is in the US a civil case. The government is trying on criminal charges. The government in its criminal case will require a jury to come to a conclusion that has a higher standard for evidence -- Beyond a reasonable doubt. The civil case has a lower standard for evidence - the jury conclusion can be based on what a reasonable person would conclude. It is not uncommon for families to file a civil case when the government is planning or in the process of trying a criminal case. They file the civil case because they stand a better chance of winning a civil case because of the lower standard of evidence. This would be their back up plan in case the jury in the criminal case is unable to come to a conclusion, or the jury finds the man "not guilty." It leaves the door open to an award of monetary compensation. |

The argument they raise as to why the accused refused their son's marriage proposal is not only flimsy but suspicious, had he disclosed the fact that he had impregnated the accused daughter . The blame for this death lies squarely on the deceased in that he should have disclosed that the accused daughter was pregnant with his child, and that he went ahead and gotten married to another woman not only shows the scope of his non commital and irresponsibility. |
