Over 80% rape cases pending in courts: Supreme Court judge

CHENNAI: More than 80 per cent of rape cases were pending in courts across the country while in Tamil Nadu alone two such cases were registered everyday in 2011, Supreme Court judge Justice P Sathasivam said on Saturday.

Seeking more proactive role by women lawyers particularly against domestic violence and gender discrimination, he said, "women lawyers' role becomes vital in such areas as those involving domestic violence, child abuses and gender discrimination".

Participating in the Golden Jubilee celebrations of the Women Lawyers Association here, he said according to the 2011 report of National Crime Record Bureau "statistics reveal that the percentage of trials pending in rape cases (across the country) is 83.6 per cent."

Further, there are about 677 rape cases which had been registered in Tamil Nadu in 2011, aggregating up to two cases being registered everyday. Women lawyers have a greater role to play (in such situations), he said.

Supreme Court judge Justice Fakkir Mohamed Ibrahim Kalifulla said "exploitation of women is reality. Women emancipation lies in the awareness about their (basic) rights."

Praising women lawyers for their talent and inherent sensitivity, former chief justice of Madras high court and Supreme Court judge M Y Eqbal said women had made their mark in the legal profession.

Just this morning on the BBC web site is a report of a Swiss woman on a camping/walking trip in Madhya Pradesh, gang-raped by 10 to 20 locals. She is in the hospital and is conscious and talking. Her husband was beaten with sticks, and I don't have a report on how he is doing. He did witness the rape.

This and other similar stories show that nothing was learned from the tragedy of Nirbhaya and the protests that followed.

Bharat is depicted as woman, as mother. All of India sworn to protect "her." Consider the contradiction between philosophy and deeds. Yet.....Rape is not about this or that nation, wealth or poverty, east or west, this or that continent, educated and illiterate, city or countryside, this religion or that. Tolerance of rape is deeply embedded in the consciousness of societies that need to take a look at the place of WOMAN, by looking at actions and deeds, not at philosophies. Philosophy comes to us as words. Words are cheap. Change is painful.

Swiss tourist gang-raped in Madhya Pradesh

A Swiss tourist was gang-raped on Friday near the Civil Lines police station in Datia district of Madhya Pradesh, police sources told The Hindu. The 39-year-old woman and her partner were on a cycling trip from central to north India, when eight men attacked the couple. The sources confirmed that the medical examination indicated, prima facie, that the woman was “brutally raped.” The attackers also robbed the couple.

After spending the day in the picturesque Orchha town, known for its several forts and temples, the couple were camping about 250 metres off National Highway 75, a furlong from the local police station, inside the forest. According to local journalists, a few villagers had met the couple on Friday evening as they arrived. However, seven or eight men came back later with clubs and, after an altercation, started beating up the man.

The attackers “tied up the man and gang-raped the woman in his presence,” DIG (Chambal Range) D.K. Arya told The Hindu. Once the woman’s complaint was registered, she was taken to Gwalior district for a medical test around 8 a.m. as Datia does not have lady doctors to conduct medical tests. By midday, the test was conducted and rape was “informally” confirmed by a three-member panel of doctors at the Kamalaraje Women and Children’s Hospital in Gwalior. Later, the woman was brought back to Datia. “She is with us in Datia and out of danger,” Mr. Arya said.

The DIG confirmed that, so far, “50-60 villagers” from Datia and adjoining areas had been detained and a massive operation launched to nab the culprits. The attackers stole Rs. 12,000 and a mobile phone from the woman, the sources said.

In 2003, a 36-year-old female Swiss diplomat was abducted from the car park of a popular New Delhi auditorium by two men, who drove away with her, raped her and dropped her off nearby. No one has been convicted for that attack.

Embassy calls for probe

New Delhi Special Correspondent writes:

The Swiss embassy, which has been in touch with the local authorities, called for swift investigation and justice in the incident.

Swiss ambassador Linus von Castelmur spoke to the victim and her partner and assured them of all possible support. Their health and treatment is the priority at the moment, said embassy officials. “The embassy is most distressed over the incident,” the Swiss ambassador said in a statement.

WoW! Since the earlier report the number of detainees has skyrocketed! But you see from that how a larger community becomes embroiled, whether they are the rapists or not. Take heart! This will change in time.

Five confess to gang-raping Swiss tourist in Madhya Pradesh, police say

NEW DELHI: Five villagers have confessed to gang-raping a Swiss tourist in Madhya Pradesh, police said on Sunday. The woman was on a cycling holiday with her husband when six men attacked the couple on Friday night, sexually assaulting the woman in front of her husband and robbing the pair, police said.

"We have detained five men and they have confessed to gang-raping the woman and attacking her husband," local police official MS Dhodee told AFP.

The five men, who eke out a living as small-scale farmers, have been arrested on charges of rape and robbery, Dhodee said.

Police are searching for a sixth man, who was also involved in the crime, he said.

The alleged rapists live in a village near the forested area where the couple had stopped to camp for the night, while on a cycling trip to Agra, Dhodee said.

"They were passing by, noticed the couple putting up their tent and saw an opportunity to attack and rape the woman," he said. Her husband was tied up during the attack.

They also stole a laptop, a mobile phone and 10,000 rupees from the couple, which the police are trying to recover, added Dhodee.

After the attack, the rape victim, aged about 40, and her husband, reported to be around 30, stopped a motorcyclist who took them to the nearest police station, said SonntagsBlick, a Swiss German-language newspaper.

She underwent a medical examination at a local hospital before leaving for Delhi, police said.

"The victim and her husband have left for Delhi, since there was no need for her to stay in hospital here," another local police official UC Shadangi told AFP.

Shadangi said that police were in touch with Swiss embassy officials, who declined to comment to AFP about the case.

The Swiss foreign ministry in Bern released a statement on Saturday expressing deep shock at the "tragic incident".

The couple arrived in Mumbai last month after visiting Iran and began a cycling holiday across India, making their way to Orchha, a popular foreign tourist haunt in Madhya Pradesh on Thursday, Shadangi said.

The attack comes just three months after thousands took to the streets in nationwide protests following the fatal gang-rape of a 23-year-old student on a bus in New Delhi.

The victim, a physiotherapy student died from internal injuries after being savagely assaulted by six men. One of her alleged attackers was found dead in his prison cell in New Delhi on Monday.

Police suspect he hanged himself, but his family says he was murdered. The government has since opened an investigation into his death.

The government is facing heavy pressure to step up efforts to protect women after the deadly gang-rape in the capital last December.

Under a new bill approved by the Cabinet last week, rapists face a minimum 20-year jail term and the death penalty if the victim dies from injuries or is left in a persistent vegetative state.

If they're pending, a stay of proceedings, indefinitely without reason given is a common tactic used by governments when they can't win a case (freeman) or don't want to (rape) just sayin..
